AMADI Standard Terms & Conditions

These terms and conditions are applicable to bookings made directly with AMADI and also apply to contact made and quotes generated through offline, online and affiliate channels.

Intellectual property

The content on this site (text, graphics, logos, icons, colours, designs, layouts) are the intellectual property of AMADI and its associates and are as such protected by Swiss and International Intellectual Property Law.

Quotations & costs

Quotations are based on anticipated costs and are subject to amendment should these anticipated costs increase due to circumstances beyond the control of AMADI.

Quoted prices are typically per person sharing, double occupancy except where indicated. Prices include planning, handling and operational charges and are based on current rates of exchange, tariffs and taxes in effect at the time of publication. AMADI reserves the right to increase prices to cover increased costs, tariffs, taxes and V.A.T. received after prices are published and to reflect fluctuations in foreign exchange markets. AMADI is under no obligation to give a breakdown in costs of any journey.

A provisional booking after quotation will be valid for 14 days. A provisional booking is confirmed by payment of deposit. Should the necessary deposit not be paid within the 14 days then the provisional booking is cancelled.

Deposit & Payments

40% of the confirmed total booking value for all services other than airline reservations is payable in the form of a non-refundable deposit on the date of confirmation.

100% of the confirmed total booking value of all airline reservations is payable on the date of confirmation.

The balance of the confirmed total booking value for all services other than airline reservations is payable 75 days prior to the date of arrival.

100% of the confirmed total booking value payable at the time of confirmation for all bookings made less than 75 days prior to the date of arrival.

Deposit and payment requirements might differ depending on specialist product and or seasonality.

Cancellations

The following cancellation fees will be payable if the booking is cancelled:

40% of the confirmed total booking value if the booking is cancelled more than 76 days prior to the date of arrival.

100% of the confirmed total booking value if the booking is cancelled 75-0 days prior to the date of arrival or in the case of a no-show.

Cancellation fees may differ due to specialist product and / or peak season travel. Airline reservations are 100% non-refundable.

Postponements

Postponements are treated on a case-by-case basis where we try to find the best possible solution for our clients. It is possible that they will be considered the same as a cancellation.

Payment methods

AMADI accepts two payment methods:

Wire transfer to one of our denominated accounts (CHF, USD, EUR, GBP).

Transfers of major crypto currencies into our wallet (BTC and ETH).

Insurance

We strongly recommend you take out suitable travel insurance to cover medical expenses, personal accidents and loss or damage to personal property or luggage.

Passports & visas

Valid passports are required for all international destinations. Please note that guests are responsible for obtaining the required documentation applicable for entry. Passports must be valid for six (6) months after the return of your journey and should also have sufficient blank pages for visas and immigration stamps. For travel to South Africa, guests must have a minimum of two blank pages in their passport for visas and immigration stamps. AMADI cannot be held responsible should you be denied entry to a country due to non-compliance with these requirements.

A copy of your valid passport must be submitted to AMADI in order to confirm air reservations made through AMADI.

Limits on liability

AMADI AG (trading as AMADI), its employees, shareholders, officers, directors, successors, and agents purchase transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers. All such persons and entities are independent contractors. As a result, AMADI is not liable for any negligent or wilful act of any such person or entity or of any third person. In addition and without limitation, AMADI is not responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.

There are many inherent risks in experiential travel of the type involved here, which can lead to illness, injury, or even death. These risks are increased by the fact that these experiences take place in remote locations, far from medical facilities. Passenger assumes all such risks associated with participating in these experiences.

Applicable Law

This site is created, maintained and controlled in Switzerland and as such, the laws of Switzerland and the jurisdiction of the Swiss courts govern this agreement.

Customer Privacy Policy:

AMADI shall take all reasonable steps to protect the personal information of users.

Country Of Domicile

This website is governed by the laws of Switzerland and AMADI chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

Variation

AMADI may, in its sole discretion, change this agreement or any part thereof at any time without notice.

Privacy Policy

General

We respect your privacy and are committed to protecting it through our compliance with this privacy policy (“Policy”). This Policy describes the types of information we may collect from you or that you may provide (“Personal Information”) on the amadijourneys.com website (“Website” or “Service”) and any of its related products and services (collectively, “Services”), and our practices for collecting, using, maintaining, protecting, and disclosing that Personal Information. It also describes the choices available to you regarding our use of your Personal Information and how you can access and update it.

This Policy is a legally binding agreement between you (“User”, “you” or “your”) and this Website operator (“Operator”, “we”, “us” or “our”). If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement, in which case the terms “User”, “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access and use the Website and Services. By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage. Collection of information

When you open the Website, our servers automatically record information that your browser sends. This data may include information such as your device’s IP address, browser type, and version, operating system type and version, language preferences or the webpage you were visiting before you came to the Website and Services, pages of the Website and Services that you visit, the time spent on those pages, information you search for on the Website, access times and dates, and other statistics.

Information collected automatically is used only to identify potential cases of abuse and establish statistical information regarding the usage and traffic of the Website and Services. This statistical information is not otherwise aggregated in such a way that would identify any particular User of the system and we do not collect or store any personally identifiable information.

Use and processing of collected information

We act as a data controller and a data processor when handling Personal Information, unless we have entered into a data processing agreement with you in which case you would be the data controller and we would be the data processor.

Our role may also differ depending on the specific situation involving Personal Information. We act in the capacity of a data controller when we ask you to submit your Personal Information that is necessary to ensure your access and use of the Website and Services. In such instances, we are a data controller because we determine the purposes and means of the processing of Personal Information.

We act in the capacity of a data processor in situations when you submit Personal Information through the Website and Services. We do not own, control, or make decisions about the submitted Personal Information, and such Personal Information is processed only in accordance with your instructions. In such instances, the User providing Personal Information acts as a data controller.

Once the retention period expires, Personal Information shall be deleted. Changes and amendments

We reserve the right to modify this Policy or its terms related to the Website and Services at any time at our discretion. When we do, we will send you an email to notify you. We may also provide notice to you in other ways at our discretion, such as through the contact information you have provided.

An updated version of this Policy will be effective immediately upon the posting of the revised Policy unless otherwise specified. Your continued use of the Website and Services after the effective date of the revised Policy (or such other act specified at that time) will constitute your consent to those changes.
