General

These Terms and Conditions (“Terms”) apply to any booking, quotation, and agreement between us, Amadi Journeys LLC FZ (“AMADI”), a company registered in the UAE (“we”, “us”, or “our”), and you. They also apply to all services (specifically safari tour and travel services in East and Southern Africa and beyond) (“Journey”) provided and/or arranged by us for you. These Terms equally apply to any of our employees, guides, officers, managers, agents, and alike, and to any supplier or third party engaged by us in relation to the Journey (“Supplier”). Therefore, any reference to us, we, or our is deemed to include such persons.

We truly appreciate you choosing us for your adventure, and we’re committed to making your Journey memorable and safe. Travelling in remote areas comes with its own set of considerations, so we’ve outlined these Terms to ensure everything runs smoothly. If you’re booking on behalf of others, you confirm you have the authority to agree to these Terms for them. This document supersedes any prior agreements.

References to “include”, “including”, “following”, and “in particular” are to be interpreted without limitation.

Intellectual property

The content on this site (text, graphics, logos, icons, colours, designs, layouts) are the intellectual property of AMADI and its associates and are as such protected by Swiss and International Intellectual Property Law.

Provisional Booking

Once we’ve provided you with a quotation for your Journey, the accommodation, flights, and other elements in the itinerary will be held provisionally by the service providers for a limited time. We’ll let you know the timeframe to confirm.

Price

What’s included and excluded in the price of your Journey varies by itinerary. Your quotation and invoice will clearly specify the inclusions, such as accommodations, meals, activities, and transfers. Any quotation is a guideline only and may change before confirmation due to factors like availability or cost adjustments. We’ll always keep you informed of any changes.

Payment and Confirmation

To confirm your Journey (turning it into a “Booking”), we require a deposit of 40% of the final quotation (“Deposit”) and a signed version of the Terms & Conditions. If we don’t receive the Deposit and signed forms by the specified date, your provisional booking may be released automatically, and we won’t be liable for any resulting losses.
Please ensure you take out full travel insurance when the Deposit is paid – we strongly recommend it for peace of mind.

The balance is payable 75 days before the planned starting date of your Booking.

All payments should be made via wire transfer to the account (and in the amount and currency) specified by us. Credit cards and checks are not accepted.

Cancellation and Postponement Policy

We understand plans can change, but bookings involve commitments to suppliers, so costs may arise in the event of cancellation or postponement. Notice must be received in writing.

76 days or more before the start date: Deposit (40%) forfeited, plus any unrecoverable third-party deposits beyond the deposit paid (see note below).

75 days or less / No-show: 100% of the total cost.

For postponements: We may, in our discretion, accept a request for postponement if made in writing and confirmed by us in writing. If accepted, your Booking will be re-quoted at the then-applicable rates, and any associated costs (like supplier fees) are for your account. We can’t guarantee changes can always be accommodated, but we’ll do our best. If we can’t accommodate, the original Booking remains in force. No postponements are possible after balance payment (75 days before departure); these are treated as cancellations with 100% cancellation fees.

Important note on third-party Suppliers: Any bookings we make on your behalf with third-party suppliers (like lodges or charter companies) are subject to their own terms, which vary by supplier.

Changes to Booking and Price

If there’s a reduction in numbers, a date change, or other adjustments to your Booking, we’ll re-quote at current rates, and any extra costs are for your account. We’ll always aim to accommodate requests, but if we can’t, the original Booking stands. Changes become binding once we agree in writing.

Your Booking is subject to change by us in the event of a Force Majeure – any circumstance beyond our reasonable control that affects delivery, like weather, health conditions, regulations, pandemics, terrorism, war, cyber threats, strikes, airline delays, increased levies/taxes, currency fluctuations, or supplier issues. Extra expenses from such changes are for your account. We reserve the right to substitute accommodations or alter the itinerary for safety or necessity, always with your best interests in mind.

Last-Minute Changes and Delays

We strive to make your travel comfortable and stick to the plan, but flexibility is key in safari adventures – delays or tweaks may occur due to operational needs or Force Majeure. We’re not responsible for related costs, but we’ll work to minimize impacts. In case of delays or late arrival, you may forfeit parts of the Journey or incur no-show fees (up to 100%). You agree to cover any additional costs we incur to accommodate or mitigate your delay.

Travel Insurance

Travelling in Africa involves inherent risks of illness, injury, death, or loss/damage of property, so we require you and your group to have comprehensive travel and medical insurance for the full duration of your Journey. This should cover cancellation, medical expenses, emergency evacuation, loss of personal effects, accidental death and disability, and trip interruption. Cover with a “cancel for any reason” clause is strongly recommended. Proof of insurance is required at booking—we don’t provide coverage, but we’re happy to advise on options. If you’re not insured, you accept personal liability and indemnify us accordingly.

General Conduct and Instructions

In safari areas, parks, and communities, specific rules apply for safety—especially around wildlife. Our guides, camp managers, or designated persons are responsible for ensuring compliance, so please follow their instructions strictly. Non-compliance may lead to expulsion from the Journey or part of it, without refund, and you’d need to arrange your own way home at your cost. We won’t be liable in such cases.

You acknowledge it’s your responsibility to ensure all precautions for safety and security, including following instructions.

Health, Visas, and Documentation

It is your responsibility to ensure that passports, visas, travel permits, health certificates, inoculations or other documentation required for the trip are obtained and are in order prior to the departure date of your trip. Any additional costs incurred either by yourself (or by AMADI on your behalf) as a result of non-compliance shall be billed to you. We provide general info but aren’t liable for issues.

Disclose any medical conditions pre-departure – we’re not liable for health-related problems. Obtain medical advice to confirm you’re fit for the Journey.

Indemnity, Release of Liability, and Assumption of Risk

Journeys like these involve natural risks – wildlife, terrain, remote locations, forces of nature, and activities like walking, driving, or flying. You accept these voluntarily at your own risk. Medical services may not always be readily available.

If your Journey includes air travel we arrange, you confirm you’re flying voluntarily as a fare-paying passenger on third-party-operated aircraft (fixed-wing or helicopters), accepting associated risks (including injury or death).

By signing these Terms, you release us from liability for any loss, injury, death, damage, or illness (unless due to our gross negligence), including those from your physical condition or worsening thereof. We’re not liable for Supplier acts/omissions, insolvency, or failures—we act as their agent.

You indemnify and hold us harmless against all claims, liabilities, expenses, losses, damages, and legal costs (including third-party claims) arising from your or a minor’s actions, negligence, or breach (except where law prohibits). This includes damage you cause to property or facilities—you’re fully liable for repairs.

Liability is limited to direct damages, not exceeding Booking cost; no consequential damages. Guardians are responsible for minors, accepting these Terms on their behalf.

You confirm authority to sign, and agree to use facilities at your own risk. Our liability reduces for your contributory negligence. We have rights to defend/settle third-party claims with recourse against you.

Carriage, Baggage, and Personal Property

Transportation is subject to carrier terms – we’re not liable for delays/cancellations. Baggage limits (e.g., 15-20kg in soft bags for charters) apply; excess is at your cost and risk. You’re responsible for personal property; no liability from us. For chartered aircraft, baggage is restricted for safety – we’ll advise specifics. Excess may require extra seats at additional cost.

As it is out of our control, we cannot accept any responsibility for the misplacement or loss of any baggage or articles of your possession whilst on your travels. Naturally, we will endeavour to reunite you with your possessions but please bear in mind that logistics may not always be favourable for the return of possessions without incurring costs. If you do require the item/s to be returned to you, please note that any costs incurred in this process will be for your own account.

Photography and Drones

We reserve the right, and you hereby permit us, to make use of any photograph or film taken by us during your Journey for general publicity purposes – let us know if you’d prefer not.

The use of drones for photography is strictly prohibited by many parks and reserves in East and Southern Africa. Do please check on the regulations of each country you are visiting to ensure that that they are permitted by law before using any drones. Even if the law permits their use, you may find that the parks, reserves, conservancies and properties that you will be visiting have a no drone policy.

Governing Law and Dispute Resolution

Governed by UAE laws. Disputes resolved by arbitration in Dubai under DIAC rules; no class actions. This is the entire agreement; no oral modifications unless written and signed by us. Severability applies—if any part is invalid, the rest remains binding. No waiver unless written.

If you are travelling with (an)other person(s), you hereby warrant that you are duly authorised on behalf of such other person(s) to bind them to your Booking. You and each such other person accept personal liability (jointly and severally) for the entire Booking. By signing below, you acknowledge understanding and agreeing to these Terms, including the integrated Release of Liability, Assumption of Risk, and Indemnity provisions. You warrant you’ve read this carefully and accept voluntarily.

Privacy Policy

General

We respect your privacy and are committed to protecting it through our compliance with this privacy policy (“Policy”). This Policy describes the types of information we may collect from you or that you may provide (“Personal Information”) on the amadijourneys.com website (“Website” or “Service”) and any of its related products and services (collectively, “Services”), and our practices for collecting, using, maintaining, protecting, and disclosing that Personal Information. It also describes the choices available to you regarding our use of your Personal Information and how you can access and update it.

This Policy is a legally binding agreement between you (“User”, “you” or “your”) and this Website operator (“Operator”, “we”, “us” or “our”). If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this agreement, in which case the terms “User”, “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access and use the Website and Services. By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy. This Policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage. Collection of information

When you open the Website, our servers automatically record information that your browser sends. This data may include information such as your device’s IP address, browser type, and version, operating system type and version, language preferences or the webpage you were visiting before you came to the Website and Services, pages of the Website and Services that you visit, the time spent on those pages, information you search for on the Website, access times and dates, and other statistics.

Information collected automatically is used only to identify potential cases of abuse and establish statistical information regarding the usage and traffic of the Website and Services. This statistical information is not otherwise aggregated in such a way that would identify any particular User of the system and we do not collect or store any personally identifiable information.

Use and processing of collected information

We act as a data controller and a data processor when handling Personal Information, unless we have entered into a data processing agreement with you in which case you would be the data controller and we would be the data processor.

Our role may also differ depending on the specific situation involving Personal Information. We act in the capacity of a data controller when we ask you to submit your Personal Information that is necessary to ensure your access and use of the Website and Services. In such instances, we are a data controller because we determine the purposes and means of the processing of Personal Information.

We act in the capacity of a data processor in situations when you submit Personal Information through the Website and Services. We do not own, control, or make decisions about the submitted Personal Information, and such Personal Information is processed only in accordance with your instructions. In such instances, the User providing Personal Information acts as a data controller.

In order to make the Website and Services available to you, or to meet a legal obligation, we may need to collect and use certain Personal Information. If you do not provide the information that we request, we may not be able to provide you with the requested products or services. Any of the information we collect from you may be used for the following purposes:

  • Send administrative information
  • Send product and service updates
  • Respond to inquiries and offer support
  • Run and operate the Website and Services

Processing your Personal Information depends on how you interact with the Website and Services, where you are located in the world and if one of the following applies: (i) you have given your consent for one or more specific purposes; (ii) provision of information is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof; (iii) processing is necessary for compliance with a legal obligation to which you are subject; (iv) processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in us; (v) processing is necessary for the purposes of the legitimate interests pursued by us or by a third party.

Note that under some legislations we may be allowed to process information until you object to such processing by opting out, without having to rely on consent or any other of the legal bases. In any case, we will be happy to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Information is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

Disclosure of information

To maintain the highest level of privacy and to protect your Personal Information to the full extent, we do not share your Personal Information with anyone and for any reason.

Retention of information

We will retain and use your Personal Information for the period necessary to comply with our legal obligations, to enforce our agreements, resolve disputes, and unless a longer retention period is required or permitted by law.

We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally. Once the retention period expires, Personal Information shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification, and the right to data portability cannot be enforced after the expiration of the retention period.

Cookies

Our Website and Services use “cookies” to help personalise your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you. We may use cookies to collect, store, and track information for security and personalization, and for statistical purposes. Please note that you have the ability to accept or decline cookies. Most web browsers automatically accept cookies by default, but you can modify your browser settings to decline cookies if you prefer.

Do Not Track signals

Some browsers incorporate a Do Not Track feature that signals to websites you visit that you do not want to have your online activity tracked. Tracking is not the same as using or collecting information in connection with a website. For these purposes, tracking refers to collecting personally identifiable information from consumers who use or visit a website or online service as they move across different websites over time. As a result, the Website and Services are not yet set up to interpret or respond to Do Not Track signals communicated by your browser. Even so, as described in more detail throughout this Policy, we limit our use and collection of your Personal Information.

The Website and Services contain links to other resources that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices of such other resources or third parties. We encourage you to be aware when you leave the Website and Services and to read the privacy statements of each and every resource that may collect Personal Information.

Information security

No data transmission over the Internet or wireless network can be guaranteed. Therefore, while we strive to protect your Personal Information, you acknowledge that (i) there are security and privacy limitations of the Internet which are beyond our control; (ii) the security, integrity, and privacy of any and all information and data exchanged between you and the Website and Services cannot be guaranteed; and (iii) any such information and data may be viewed or tampered with in transit by a third party, despite best efforts.

Data breach

In the event we become aware that the security of the Website and Services has been compromised or Users’ Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, we reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, we will make reasonable efforts to notify affected individuals if we believe that there is a reasonable risk of harm to the User as a result of the breach or if notice is otherwise required by law. When we do, we will send you an email.

Changes and amendments

We reserve the right to modify this Policy or its terms related to the Website and Services at any time at our discretion. When we do, we will send you an email to notify you. We may also provide notice to you in other ways at our discretion, such as through the contact information you have provided.

An updated version of this Policy will be effective immediately upon the posting of the revised Policy unless otherwise specified. Your continued use of the Website and Services after the effective date of the revised Policy (or such other act specified at that time) will constitute your consent to those changes. However, we will not, without your consent, use your Personal Information in a manner materially different than what was stated at the time your Personal Information was collected.
